Water Law in Colorado


Q: Does Colorado Senate Bill 09-080 allow me to collect rainwater?

A: 

No. The new law requires landowners to meet six criteria in order to take advantage of the limited collection provisions.

  1. The property must be residential
  2. The landowner must use a well or be legally entitled to a well
  3. The well permit must indicate that the well is only for domestic purposes
  4. No water is available in the area from a municipality or water district
  5. Rainwater can only be collected from the roof
  6. The water can only be used for purposes identified on the well permit

All of these provisions must be met to allow rainwater collection. Therefore, if you receive water from the City of Lafayette, you are not allowed to collect rainwater at all.
